Terms and Conditions
Definitions.
The “Customer” refers to the person or company purchasing the goods. The “goods” refer to the items supplied by STAPLES4YOU.COM to the Customer under the contract between them. Any goods ordered are taken with the understanding that the Customer has committed themselves fully and is subject to STAPLES4YOU.COM's Terms and Conditions.
Prices
Prices quoted exclude VAT (if registered) or any other taxes. STAPLES4YOU.COM reserves the right to alter prices without prior notification and shall
not be bound by any price quote that is not in writing. Written quotations remain valid for four weeks. If, between the date of order and the date of delivery, there are any unforeseen price increases in the cost of materials, labor, transport, overhead expenses, or any other costs, then STAPLES4YOU.COM shall be entitled to increase the price of any goods.
Variations of Quantity and Size
Variations in quantity and size up to 5% shall not entitle the Customer to reject the goods.
Payment
Payment must be made with placement of order, except when credit facilities have been approved. STAPLES4YOU.COM’s standard terms of credit are strictly 28 days from the date of invoice. STAPLES4YOU.COM reserves the right to withdraw credit facilities at any time without notification. STAPLES4YOU.COM reserves the right to charge interest of 2% per month on all accounts unpaid for 29 days or more.
Delivery
While STAPLES4YOU.COM will make every effort to deliver at the required date and time, this date and time are not guaranteed as part of the contract.
The signature of any employee or person accepting delivery at the specified address shall serve as proof of receipt of goods. Should the goods be refused or unaccepted, the Customer shall be liable for any additional costs including carriage, storage, losses, and damage, etc. STAPLES4YOU.COM reserves the right to dispatch alternative goods that may not be exactly as specified. STAPLES4YOU.COM reserves the right to amend or change material specifications and formulation without prior notification.
Loss/Damage/Returns
STAPLES4YOU.COM shall not be held liable for any consequential or force majeure loss or damage of any kind, however caused. Any claims made by the Customer should be made in writing within 14 days of the dispatch date. Return of goods must be subject to an agreement between STAPLES4YOU.COM and the Customer. Goods must be unharmed, unused, and in a resalable condition. Bespoke or special items, which are not standard stock products, are non-returnable. During manufacture, these goods are subject to a +/- tolerance of 5%. Following an agreement between STAPLES4YOU.COM and the Customer, any goods returned shall be subject to a 10% restocking charge. Any items are sold on a non-returnable basis unless the goods are accepted by the manufacturer as faulty.
Passing of Property
Goods sold will remain the property of STAPLES4YOU.COM until all sums due to STAPLES4YOU.COM from the Customer are paid in full. Should the goods become constituents of or converted into other goods, then such other goods shall become the property of STAPLES4YOU.COM until paid for in full. Following a dispute, STAPLES4YOU.COM retains the right to require delivery of the goods from the Customer. Failure of delivery permits STAPLES4YOU.COM to enter the premises of the Customer and repossess the goods.
Warranty
The Customer is responsible for determining whether any product sold through STAPLES4YOU.COM is fit for a particular purpose and suitable for the intended application. All statements, verbal and written, including technical information and recommendations, are not guaranteed by STAPLES4YOU.COM but are based on what is believed to be reliable. Neither STAPLES4YOU.COM nor the manufacturer shall be held responsible or liable for any injury, damage, or loss, consequential or direct, arising out of use or inability to use the product. STAPLES4YOU.COM makes no warranties, express or implied, including, but not limited to, any implied warranty of merchantability or fitness for a particular purpose.
Law
The proper law of the contract shall be Scottish law, and the Customer submits to the jurisdiction of the Scottish courts of law upon purchase.
